Guy falling off his bike to prove his point, is just a guy falling off his bike with point unproven

Update:  Post formerly called "Oh zero tolerance" has been renamed into "Guy falling off his bike to prove his point, is just a guy falling off his bike with point unproven".  Apparently Zero Tolerance is not zero tolerance.  It is "Follow this law, and when unsafe, use your best judgement" AKA Biker who doesn't want to follow the rules doesn't like getting fined...here's the actual law (H/T: SMS)

34 RCNY § 4-12(p) Bicycles.
(1) Bicycle riders to use bicycle lanes. Whenever a usable path or lane for bicycles has been provided, bicycle riders shall use such path or lane only except under any of the following situations:
(i) When preparing for a turn at an intersection or into a private road or driveway.
(ii) When reasonably necessary to avoid conditions (including but not limited to, fixed or moving objects, motor vehicles, bicycles, pedestrians, pushcarts, animals, surface hazards) that make it unsafe to continue within such bicycle path or lane.

A creative way to protest zero tolerance...of bike lanes.  You have to admire his commitment level.
